Property Rules & Regulations
RULES AND REGULATIONS TENANT RESPONSIBILITIES These Rules and Regulations apply to all tenants, occupants, household members, guests, and invitees of the Property. They are intended to protect the Property, maintain a safe and comfortable environment, and prevent disturbances to neighbors and other residents. Tenants are responsible for complying with these Rules and Regulations throughout the tenancy. ──────────────────────────────────────── 1. NOISE AND NEIGHBORS ──────────────────────────────────────── • Maintaining reasonable noise levels at all times and avoiding loud music, excessive television or speaker volume, yelling, parties, excessive vehicle noise, repeated animal noise, or any other conduct that unreasonably disturbs or interferes with neighbors or other occupants, particularly between the hours of 10:00 P.M. and 8:00 A.M. • Being respectful of neighboring residents and ensuring that guests and other occupants do not create unreasonable disturbances. • Taking reasonable steps to immediately reduce excessive noise after receiving a complaint or request from Landlord, Property Management, another resident, or law enforcement. ──────────────────────────────────────── 2. SNOW AND ICE REMOVAL ──────────────────────────────────────── • Promptly removing snow and ice from sidewalks, walkways, steps, porches, driveways, parking areas, and other exterior areas assigned to Tenant. • Applying salt or another appropriate ice-melting material as reasonably necessary to maintain safe access. • Keeping entrances, exits, sidewalks, and walkways reasonably clear and accessible during winter conditions. • Not depositing snow onto neighboring properties, public roadways, fire hydrants, building entrances, or other locations where it may create an obstruction or unsafe condition. ──────────────────────────────────────── 3. LAWN AND EXTERIOR AREAS ──────────────────────────────────────── • Keeping sidewalks, porches, patios, balconies, yards, driveways, and exterior areas assigned to Tenant clean and free of trash, debris, and unnecessary personal property. • Not removing, planting, substantially trimming, or modifying trees, shrubs, landscaping, gardens, or other permanent exterior features without Landlord's prior written approval. ──────────────────────────────────────── 4. CLEANLINESS ──────────────────────────────────────── • Keeping the Premises clean, sanitary, and in reasonably good condition. • Regularly cleaning kitchens, bathrooms, floors, appliances, and other interior surfaces. • Promptly cleaning water spills and excessive moisture to prevent mold, mildew, or water damage. • Keeping kitchen appliances, exhaust fans, bathroom fans, and ventilation systems reasonably clean. • Preventing excessive accumulation of garbage, food waste, grease, dirt, or debris. ──────────────────────────────────────── 5. GARBAGE AND RECYCLING ──────────────────────────────────────── • Properly disposing of household garbage and recycling in designated containers. • Following applicable garbage and recycling collection schedules and requirements. • Placing garbage and recycling containers at the appropriate collection location when required and returning containers to their designated location following collection. • Not allowing garbage, furniture, appliances, construction materials, or other waste to accumulate inside or outside the Property. ──────────────────────────────────────── 6. ROUTINE MAINTENANCE ──────────────────────────────────────── • Replacing burned-out light bulbs. • Replacing batteries in smoke detectors, carbon monoxide detectors, thermostats, garage door openers, keypads, remote controls, and other battery-operated devices, where applicable and permitted by law. • Replacing HVAC/furnace filters, if applicable, at least every ninety (90) days or more frequently if recommended by the manufacturer. • Replacing refrigerator water filters and similar consumable filters, where applicable. • Resetting tripped circuit breakers and GFCI outlets when appropriate. • Keeping windows, doors, screens, locks, and weather stripping clean and in reasonably good operating condition. • Promptly reporting any plumbing leaks, electrical issues, water intrusion, appliance malfunction, heating problem, or any other condition that could cause damage to the Premises. ──────────────────────────────────────── 7. PLUMBING AND DRAINS ──────────────────────────────────────── • Keeping sinks, tubs, showers, toilets, and drains free of clogs caused by Tenant's use. • Flushing only normal amounts of human waste and toilet paper through toilets. • Not flushing or disposing of baby wipes, including "flushable" wipes, paper towels, facial tissues, feminine hygiene products, diapers, cotton products, dental floss, excessive hair, grease, fats, oils, food waste, cat litter, cleaning wipes, plastic, rubber, or other foreign materials through the plumbing system. • Promptly reporting slow drains, recurring clogs, leaks, sewer backups, or other plumbing problems. • Being responsible for plumbing service and repair costs when a plumber or other qualified contractor determines that the problem was caused by Tenant misuse, negligence, or prohibited materials, as provided by the Lease. ──────────────────────────────────────── 8. DAMAGE TO THE PROPERTY ──────────────────────────────────────── • Exercising reasonable care to prevent damage to the Property. • Being responsible for damage beyond ordinary wear and tear caused by Tenant, household members, occupants, guests, invitees, pets, contractors, or other persons under Tenant's control. • This includes damage to doors, door frames, locks, windows, screens, walls, flooring, cabinets, countertops, appliances, fixtures, landscaping, and other portions of the Property resulting from negligence, misuse, excessive force, accident, or unauthorized alterations. • Promptly reporting damage so that additional damage can be prevented. • Being responsible for additional damage caused by failure to promptly report a known maintenance problem, as provided by the Lease. ──────────────────────────────────────── 9. WATER USAGE ──────────────────────────────────────── • Using water reasonably and avoiding unnecessary or excessive water consumption. • Promptly reporting leaking toilets, faucets, pipes, appliances, or other plumbing fixtures. • Not filling swimming pools, hot tubs, large containers, or using unusually large quantities of water for irrigation or other non-ordinary residential purposes without Landlord's prior written approval where Landlord is responsible for the water bill. • Being responsible, to the extent provided by the Lease and applicable law, for excessive water charges or damage caused by Tenant's negligence, misuse, unauthorized high-volume water use, or failure to timely report a known leak. ──────────────────────────────────────── 10. HEATING AND FROZEN PIPES ──────────────────────────────────────── • Maintaining reasonable heat during freezing weather where Tenant controls the thermostat. • Not intentionally turning off or disabling the heating system during freezing conditions. • Immediately reporting any heating system failure during freezing weather. • Taking reasonable precautions to prevent frozen plumbing. • Being responsible for damage caused by frozen or burst pipes to the extent the damage results from Tenant's negligence or failure to timely report a known heating problem. ──────────────────────────────────────── 11. ALTERATIONS AND EXTERIOR INSTALLATIONS ──────────────────────────────────────── • Obtaining Landlord's prior written approval before installing, constructing, placing, assembling, or attaching any temporary or permanent structure, fixture, improvement, landscaping feature, equipment, or other substantial object on the Property. • Items requiring approval include, but are not limited to, sheds, fences, gates, pools, hot tubs, trampolines, swing sets, playground equipment, gazebos, pergolas, decks, patios, fire pits, storage containers, satellite dishes, antennas, EV chargers, generators, gardens, raised garden beds, trees, shrubs, signs, and cameras attached to the building. • Removing any unauthorized installation and restoring the affected area within five (5) business days after notice from Landlord, as required by the Lease. ──────────────────────────────────────── 12. SMOKE AND CARBON MONOXIDE DETECTORS ──────────────────────────────────────── • Never removing, disconnecting, disabling, covering, obstructing, or intentionally damaging a smoke detector or carbon monoxide detector. • Promptly reporting any detector that is missing, damaged, malfunctioning, or requires service. • Replacing batteries where that responsibility is assigned to Tenant and permitted by applicable law. ──────────────────────────────────────── 13. SMOKING ──────────────────────────────────────── • Complying with all smoking restrictions contained in the Lease. • Ensuring household members, occupants, guests, and invitees also comply with applicable smoking restrictions. • Being responsible for damage caused by prohibited smoking as provided by the Lease. ──────────────────────────────────────── 14. PARKING AND VEHICLES ──────────────────────────────────────── • Parking only in areas authorized for Tenant's use. • Not blocking driveways, sidewalks, entrances, fire hydrants, fire lanes, or other access areas. • Not parking vehicles on lawns or landscaped areas. • Not storing inoperable or unregistered vehicles on the Property without Landlord's prior written approval. • Not performing substantial vehicle repairs on the Property without Landlord's prior written approval. • Preventing vehicles from leaking excessive oil, fuel, coolant, or other automotive fluids onto the Property. ──────────────────────────────────────── 15. GUESTS AND OTHER OCCUPANTS ──────────────────────────────────────── • Being responsible for the conduct of Tenant's guests and invitees while they are on the Property. • Ensuring guests and invitees comply with applicable provisions of the Lease and these Rules and Regulations. • Not permitting unauthorized persons to establish residency or occupancy at the Property contrary to the Lease or applicable law. ──────────────────────────────────────── 16. PETS AND ANIMALS ──────────────────────────────────────── • Not keeping pets or animals at the Property without Landlord's prior approval where such approval is required by the Lease, except animals protected by applicable law. • Keeping approved animals under reasonable control and preventing excessive noise, property damage, accumulation of waste, or unreasonable interference with neighboring residents. • Promptly cleaning and properly disposing of animal waste. ──────────────────────────────────────── 17. FIRE SAFETY AND OUTDOOR COOKING ──────────────────────────────────────── • Using grills, propane equipment, outdoor cooking equipment, and similar devices only in locations and manners permitted by applicable fire and safety requirements. • Not installing or using fire pits or similar outdoor fire features without Landlord's prior written approval. • Keeping combustible materials reasonably away from furnaces, water heaters, electrical equipment, and other potential ignition sources. ──────────────────────────────────────── 18. COMMON AREAS ──────────────────────────────────────── • Keeping hallways, stairs, entrances, walkways, basements, and other common areas free from personal property and obstructions except where Landlord has specifically designated an area for storage. • Not blocking exits, stairs, fire escapes, utility equipment, electrical panels, furnaces, water heaters, or other building systems. ──────────────────────────────────────── 19. MAINTENANCE REQUESTS AND SERVICE CALLS ──────────────────────────────────────── • Submitting maintenance requests promptly when repairs are required. • Providing reasonable access for Landlord, Property Management, or authorized contractors to inspect or repair reported conditions in accordance with the Lease and applicable law. • Not attempting repairs involving electrical wiring, plumbing systems, gas lines, HVAC systems, structural components, roofing, or other major building systems without Landlord's prior written approval. • Being responsible for reasonable service-call and repair costs when the issue is determined to have resulted from Tenant misuse, negligence, failure to perform Tenant's routine maintenance responsibilities, or another condition for which Tenant is responsible under the Lease. ──────────────────────────────────────── 20. GENERAL PROPERTY CONDUCT ──────────────────────────────────────── • Using the Property primarily for lawful residential purposes as provided by the Lease. • Not intentionally or negligently damaging, defacing, destroying, or removing any portion of the Property. • Not creating unsafe, unsanitary, hazardous, or unreasonably disruptive conditions. • Complying with applicable federal, state, and local laws and regulations relating to Tenant's use and occupancy of the Property. ──────────────────────────────────────── 21. COMPLIANCE WITH RULES AND REGULATIONS ──────────────────────────────────────── Tenant is responsible for reviewing and complying with these Rules and Regulations throughout the tenancy. These Rules and Regulations supplement the Residential Lease Agreement and do not replace the Lease. If there is a conflict between these Rules and Regulations and the Lease, the Lease shall control unless otherwise required by applicable law. Landlord may reasonably update operational Rules and Regulations relating to the use, care, safety, maintenance, and management of the Property from time to time and may provide notice of such updates electronically or through Landlord's online tenant portal. Any updated Rule or Regulation shall be reasonable, shall apply prospectively, and shall not be used to materially modify Rent or other material financial or contractual terms of the Lease except by written agreement or as otherwise permitted by applicable law. Current Rules and Regulations are available through the Tenant Portal at: https://nasdmanagement.com/TenantPropertyRules Tenant should periodically review the Tenant Portal and any notices provided by Landlord or Property Management for current property information and Rules and Regulations. ──────────────────────────────────────── IMPORTANT ──────────────────────────────────────── These Rules and Regulations are a summary of common Tenant responsibilities and are intended to supplement the Lease. Tenant remains responsible for complying with all applicable provisions of the signed Residential Lease Agreement. Where a responsibility stated above applies only when specifically assigned to Tenant under the Lease or applicable property-specific terms, the Lease and those property-specific terms shall control.
